Deposit & Sales Agreements

I. Deposit Terms

Amount

A 10% non-refundable deposit is required per kitten.

Purpose

This deposit confirms the Buyer’s intent to purchase and ensures the kitten is held exclusively for the Buyer and removed from the market.

Application

The full deposit amount shall be applied toward the final purchase price.

Non-Refundable

Should the Buyer decide not to proceed with the purchase for any reason, the deposit is forfeited. It is not transferable to other individuals or, except as noted below, to future litters.

II. Final Payment

Balance Due

The remaining balance is due and payable before or at the time the kitten leaves the Seller’s possession.

Accepted Methods

Cash, Cash App, Zelle, or Venmo.

Personal Checks

Under no circumstances are personal checks accepted for the deposit or the final balance.

III. Seller’s Right of Refusal & Refunds

BestView reserves the right to cancel the sale at any time prior to the kitten leaving our possession under the following circumstances:

Placement Concerns

If the Seller determines, in their sole discretion, that the Buyer or the home environment is not a satisfactory match for the kitten’s well-being, the Seller will notify the Buyer in writing. The deposit will be refunded in full and all agreements will become null and void.

Breeder Retention

If the Seller decides to keep the kitten for their own breeding program, the deposit will be refunded in full, or the Buyer may choose to apply the deposit to a different available kitten or a future litter.

IV. Acceptance

Payment of the deposit constitutes the Buyer’s full acceptance of the terms and conditions within this Deposit Agreement. This agreement takes effect on the date the payment is received.

I. Buyer Obligations

The Buyer agrees to each of the following terms. The full agreement requires initials on each item.

• Non-Refundable Sale All sales are final. Buyer understands that BestView does not offer cash refunds. Any remedy for health issues is limited to the replacement terms outlined in this agreement.
• Medical Maintenance Buyer agrees to provide routine medical care at their own expense. All vaccinations must be kept up to date to maintain the health of the kitten.
• Quarantine It is best practice to isolate the new kitten from all other household pets for a minimum of 14 days. This protects both the kitten and your existing pets during the stress of transition.
• No Re-Homing to Facilities Under no circumstances shall this kitten be sold, leased, or surrendered to a shelter, research facility, pet store, or rescue.
• Right of First Refusal If the Buyer can no longer care for the kitten at any point in its life, the Buyer must contact BestView. BestView will either take the cat back or assist in finding a suitable new home.
• Transition & Communication Transitioning is stressful for kittens. Buyer must notify BestView immediately if the kitten shows signs of poor adjustment, behavioral changes, or health concerns.
• Medical Expense Liability BestView is not responsible for any veterinary or medical expenses incurred by the Buyer. To the best of our knowledge, the kitten is healthy and free of zoonotic diseases at the time of transfer.
• Strict No-Declaw Policy The kitten shall never be declawed. Declawing is a major surgical mutilation that voids all health guarantees and often leads to lifelong behavioral and physical issues.
• Indoor Lifestyle & Safety This kitten is sold for indoor life only. If taken outdoors, the kitten must be harness-trained/leashed or kept in a secure outdoor enclosure (Catio) under direct supervision.

II. BestView Guarantees

• Vaccination Status Kittens are transferred with age-appropriate core vaccinations. If the kitten is under 16 weeks old, it has had two FVRCP shots and will require a third — and most important — FVRCP shot after 16 weeks of age. Vaccination records will be provided.
• Registration This kitten is eligible for registration through TICA. Seller will provide the TICA breeder slip upon completion of the sale.
• Initial Health Warranty BestView warrants the kitten is in good health at the time of departure. The kitten has received a comprehensive veterinary exam including auscultation (heart/lungs), and eye, ear, and skin checks.
• Genetic Guarantee — PRA-b & PK-Def Both parents have tested N/N for Bengal Progressive Retinal Atrophy (PRA-b) and Pyruvate Kinase Deficiency (PK-Def). This kitten is guaranteed to never develop these specific genetic conditions. If either condition is diagnosed by a licensed veterinarian, BestView will replace the kitten at no charge.
• HCM & Congenital Health — 5-Year Pro-Rated Guarantee We offer a pro-rated replacement credit against fatal congenital defects, including HCM, for 5 years from the date of purchase. These percentages represent a credit toward a new kitten:

  A necropsy performed by a licensed veterinarian with a formal diagnostic report confirming cause of death is required to trigger this guarantee.
• FIP Replacement Policy Feline Infectious Peritonitis (FIP) is a mutation of the common Feline Coronavirus (FCoV). While we cannot guarantee a kitten is FCoV-free, if a kitten passes from FIP within the first year of life, BestView will provide a replacement kitten at no charge upon receipt of a licensed veterinarian’s report confirming the diagnosis.
• Seller Availability & Replacement Limitation Any replacement provided under this agreement is contingent upon the Seller being an active breeder of Bengals at the time the guarantee is triggered. All replacements shall be a BestView kitten of the Seller’s choosing, based on current availability. If the Seller has ceased all breeding operations at the time a claim is made, this health guarantee is considered expired, and the Seller shall have no further financial or legal obligation to the Buyer.

III. Health Check Requirement

• Mandatory Vet Exam The Buyer must have the kitten examined by a licensed veterinarian within 7 days of taking possession. This appointment should be booked in advance of pickup — many veterinary practices are booked weeks out.
  • Failure to complete this exam within the 7-day window renders all health guarantees null and void.
  • If the veterinarian identifies a life-threatening or non-curable condition, the Buyer must provide the medical record to BestView immediately to arrange for a return and replacement.

IV. Disclosures & Special Notes

Any disclosures or alterations specific to your kitten will be documented in this section of the full signed agreement. If no alterations have been discussed, this section will be marked “N/A”. Both parties must initial this section.
